Data Deletion Policy

At 2themoon.ai, we respect your right to control your personal data. This Data Deletion Policy explains your rights regarding data deletion, how to request the removal of your information from our platform, and how we process such requests in compliance with applicable privacy laws, including GDPR, CCPA, and other data protection regulations.

1. YOUR RIGHT TO DELETE DATA

You have the right to request deletion of your personal information from our systems. This includes, but is not limited to:

  • Account Information: Name, email address, phone number, profile data, business information, and account settings
  • AI Interaction Data: Conversation history, prompts, inputs, and AI-generated responses from all AI agents (Orbit, Luna, Aurora, Atlas, Callisto, Apollo, and others)
  • Uploaded Content: Files, documents, images, and other data you have uploaded or shared with our AI agents
  • Voice Data: Voice recordings, transcripts, and audio files from voice interactions with AI agents
  • Usage Data: Activity logs, session data, preferences, and interaction patterns
  • Third-Party Integration Data: Data retrieved from connected services (e.g., QuickBooks, Xero) and integration credentials
  • Payment Information: Payment history and billing records (except data required for legal compliance, such as tax records)

Important Note: Some data may be retained if required by law, necessary for fraud prevention, needed to maintain service integrity, or required for legitimate business purposes (e.g., dispute resolution, legal compliance). We will inform you of any data that cannot be deleted and the reason for retention.

2. HOW TO REQUEST DATA DELETION

You can request deletion of your data through the following methods:

2.1 Self-Service Deletion (Partial)

You may delete certain data directly through your account settings or user dashboard, including individual conversations, uploaded files, and specific AI interaction history. However, complete account and data deletion requires a formal request as described below.

2.2 Formal Deletion Request

To request complete deletion of your account and all associated data, please submit a formal deletion request by emailing us at:

Your deletion request must include:

  • Your full name
  • The email address associated with your account
  • A clear statement requesting data deletion (e.g., "I request deletion of all my personal data from 2themoon.ai")
  • Specific data categories you want deleted (if requesting partial deletion)
  • Any additional information that may help us locate your data

Identity Verification: To protect your account security, we may request additional identity verification before processing your deletion request. This may include confirming your identity through your registered email address or other verification methods.

3. PROCESSING DATA DELETION REQUESTS

Once we receive and verify your deletion request, we will process it as follows:

  • Verification Period: We will verify your identity and account ownership within 3-5 business days of receiving your request
  • Processing Timeline: Verified deletion requests are typically processed within 7-30 business days, depending on the scope and complexity of the deletion
  • Deletion Process: Your data will be permanently removed from our active production systems, databases, and user-facing interfaces
  • Anonymized Data: Some anonymized or aggregated data that cannot be linked to you may be retained for analytics and service improvement purposes
  • Backup Systems: Data may persist in encrypted backup systems for a limited period (typically 30-90 days) due to system architecture. These backups are not used for active processing and will be permanently deleted during routine backup rotation
  • Confirmation: Upon completion, we will send you a confirmation email that your deletion request has been processed

4. DATA WE MAY NOT BE ABLE TO DELETE

In certain circumstances, we may be legally required or permitted to retain some information, even after a deletion request:

  • Legal Compliance: Data required to comply with legal obligations, such as tax records, billing information, and financial transaction records (typically retained for 7 years as required by law)
  • Fraud Prevention & Security: Information necessary to detect, prevent, or investigate fraud, security threats, or unauthorized access
  • Dispute Resolution: Data relevant to ongoing or potential legal disputes, claims, or investigations
  • Service Integrity: Information necessary to maintain the integrity and security of our Service, including system logs and security audit trails
  • Anonymized Data: Aggregated or anonymized data that cannot be used to identify you
  • Third-Party Data: Data stored by third-party services you have integrated (e.g., QuickBooks, Xero) must be deleted through those services' own deletion processes

If we cannot delete certain data, we will inform you of which data must be retained and the specific legal or business reason for retention. We will minimize the retention period and ensure such data is only used for the stated purposes.

5. ACCOUNT DELETION

If you request complete account deletion, the following will occur:

  • Your account will be permanently closed and deactivated
  • All personal data linked to your account will be deleted (subject to legal retention requirements)
  • All conversation history, AI interactions, and uploaded content will be removed
  • Active subscriptions will be canceled, and no further charges will be made
  • Third-party integrations will be disconnected, and integration credentials will be deleted
  • You will lose access to all Service features and data immediately upon account deletion
  • This action is permanent and cannot be reversed

Important: Before requesting account deletion, please ensure you have exported or saved any data you wish to retain, as account deletion is irreversible. We recommend downloading your conversation history and important files before submitting a deletion request.

6. DATA DELETION FOR EU & UK RESIDENTS

If you are located in the European Union or United Kingdom, you have additional rights under GDPR:

  • Right to erasure ("right to be forgotten") - you can request deletion of your personal data without undue delay
  • We will respond to your deletion request within one month (may be extended by two months for complex requests)
  • If we cannot delete your data, we will explain the reason and inform you of your right to lodge a complaint with a supervisory authority
  • You have the right to object to processing of your personal data for certain purposes

7. DATA DELETION FOR CALIFORNIA RESIDENTS

If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA):

  • Right to deletion - you can request deletion of personal information we have collected about you
  • We will verify your identity before processing your request
  • We will respond within 45 days (may be extended by an additional 45 days if reasonably necessary)
  • We will not discriminate against you for exercising your deletion rights
